We took the president to SCOTUS to defend birthright citizenship – and we won.

The Supreme Court just ruled in our favor, blocking the president's executive order attempting to end birthright citizenship. This is a major victory for all Americans, with a huge impact for immigrant families here in Maine and around the country.

In its 6-3 decision, the court struck down President Trump's executive order banning birthright citizenship. The decision in our case, Trump v. Barbara, reaffirms what the Constitution has made clear for over 150 years: if you are born in the United States, you are a citizen of the United States.

Just hours after the president signed his executive order to end birthright citizenship back in 2025, we immediately sued, and courts quickly blocked the order. They saw it for what it was – a direct attack on what it means to be an American and a blatant rejection of the 14th Amendment. The administration appealed to the Supreme Court, and the case was argued on April 1, 2026.

Now, the nation’s highest court has officially weighed in, ruling that no president can rewrite the Constitution with the stroke of a pen.

Today's decision preserves the vision of our multicultural democracy for future generations and reaffirms a fundamental truth: in America, our constitutional rights should never depend on who holds power.

Birthright citizenship remains one of the clearest expressions of our nation's commitment to equality, fairness, and belonging. Today's decision preserves the vision of our multicultural democracy for future generations and reaffirms a fundamental truth: in America, our constitutional rights should never depend on who holds power.

We brought this case alongside the ACLU Immigrants' Rights Project, ACLU of New Hampshire, ACLU of Massachusetts, Asian Law Caucus, Legal Defense Fund, and Democracy Defenders Fund.

Our work to champion civil rights and civil liberties is far from over. But today's decision is a powerful reminder that when people come together to protect and defend our fundamental freedoms, we can win.

Defending Birthright Citizenship at the Supreme Court

President Trump has targeted immigrants since his first day in office, and his efforts to eliminate birthright citizenship are at the center of his cruel agenda to redefine who gets to be an American. But the 14th Amendment guarantees citizenship to children born in the United States — and President Trump is not above the Constitution.
