A federal court in New Hampshire will hear arguments in our new nationwide class-action lawsuit challenging the Trump administration’s executive order restricting birthright citizenship.

WHAT:

A federal court in New Hampshire will hear arguments in a new nationwide class-action lawsuit challenging the Trump administration’s executive order restricting birthright citizenship. The lawsuit was filed June 27, shortly after a Supreme Court ruling that potentially opens the door for partial enforcement of the executive order. That ruling was set to take effect 30 days from that decision date.

Three other lawsuits originally obtained nationwide injunctions protecting everyone subject to the order, but the Supreme Court’s ruling threatens to narrow those injunctions, potentially leaving many children without protection.

This new case, Barbara v. Donald J. Trump, seeks protection for all impacted families in the country, filling the gaps that may be left by the existing litigation.

WHO:

The American Civil Liberties Union, ACLU of New Hampshire, ACLU of Maine, ACLU of Massachusetts, Legal Defense Fund, Asian Law Caucus, and Democracy Defenders Fund filed the lawsuit on behalf of a proposed class of babies subject to the executive order, and their parents.

The groups will be in court seeking certification of a nationwide class and halting the order from taking effect as the case is litigated.

District Judge Joseph Laplante will preside.
