The federal appeals court in Boston will hear arguments in NHICS v. Trump on Friday, August 1, at 3 p.m.

WHAT: 

A federal appeals court in Massachusetts will hear arguments in a lawsuit challenging the Trump administration’s executive order restricting birthright citizenship. The case, New Hampshire Indonesian Community Support v. Donald J. Trump, was the first to challenge the order. It was filed just hours after the inauguration by the ACLU of Maine and others. In February, the federal judge in this case temporarily blocked the executive order from taking effect, prompting the appeal to the First Circuit Court of Appeals.

In addition, after the Supreme Court’s June ruling limiting the use of nationwide injunctions in three other challenges to the executive order, the attorneys who brought New Hampshire Indonesian Community Support v. Donald J. Trump filed a second case, Barbara v. Trump. In Barbara, the court certified a class of all babies subject to the executive order and blocked its enforcement against them. The government has not appealed or sought an emergency stay of that ruling.

The American Civil Liberties Union, ACLU of New Hampshire, ACLU of Maine, ACLU of Massachusetts, Asian Law Caucus, Democracy Defenders Fund, and Legal Defense Fund filed New Hampshire Indonesian Community Support v. Donald J. Trump on behalf of New Hampshire Indonesian Community Support, League of United Latin American Citizens (LULAC), and Make the Road New York.

Friday, August 1; the afternoon court session begins at 3 p.m., with this case scheduled as the second argument.
